9punto5 Terms of Service

Acceptance of these terms

Accessing or using the Service means accepting all of the terms below. Anyone who does not agree with them must not use the Service. If any term is unclear, you can write to contacto@9punto5.cl.

Changes to these terms

We reserve the right to modify these Terms at any time. For example, we may need to change these Terms if we introduce a new feature or for some other reason.

Minor or wording changes, such as corrections, clarifications or contact updates, may be published without notice by email. However, when a change is relevant, that is, when it modifies rights, creates or restricts obligations, or alters material conditions of use of the Service in a way that could reasonably change expectations about the Service, we will send a notice by email to the address associated with the account or provided in Service processes, as far in advance as possible before it takes effect.

Whenever we make changes to these Terms, the changes will take effect after we publish the revised Terms (shown by the revised date at the top of these Terms) or after an express acceptance if we provide a mechanism for it (such as a confirmation click or an accept button). You should check 9punto5.cl periodically for changes to these Terms.

Continued use of the Service after the revised Terms take effect means acceptance of those changes.

Privacy policy

How we collect and use information about the people who use the Service is described in the Privacy policy.

Third-party services

From time to time, we may provide links to third-party websites or services that we do not own or control. Use of the Service may also include applications developed or owned by a third party. Use of those third-party applications, websites and services is governed by that party’s own terms of service or privacy policies. You should read the terms and conditions and the privacy policy of any third-party application, website or service before using it.

Creating accounts

By creating an account or using another service to sign in to the Service, you agree to keep the corresponding password secure and to assume the risks of unauthorized access to any data or other information provided to the Service.

Any breach of the Service’s security must be reported to contacto@9punto5.cl as soon as possible.

Content and conduct

The Service may allow you to post, link and otherwise make content available. Each user is responsible for the content they make available on the Service, including its legality, reliability and appropriateness.

By posting, linking or making content available on the Service, you grant 9punto5 the right and license to use, reproduce, modify, publicly perform, publicly display and distribute that content on or through the Service. We may format the content for display throughout the Service, but we will not edit or revise the substance of the content itself.

Apart from the limited right described above, you keep all rights to the content you post, link or otherwise make available on or through the Service.

Posted content can be removed by deleting it. Once deleted, it will no longer appear on the Service, but copies may remain in our system or backups for a period of time. We will retain web server access logs for, at most, an immediate period and then delete them.

You may not post, link or make available on or through the Service any of the following:

• Content that is libelous, defamatory, bigoted, fraudulent or deceptive;
• Content that is illegal or would otherwise create legal liability for 9punto5;
• Content that may infringe or violate any patent, trademark, trade secret, copyright, right of privacy, right of publicity or other intellectual or other right of any party;
• Mass or repeated promotions, political campaigns or unsolicited commercial messages (SPAM);
• Private information of any third party (for example, addresses, phone numbers, email addresses, social security numbers and credit card numbers); and
• Viruses, corrupted data or other harmful, disruptive or destructive files or code.

You may also not, in connection with the Service or other users:

• Use the Service in any way that may interfere with, disrupt, negatively affect or prevent other users from fully enjoying the Service, or that may damage, disable, overload or impair the operation of the Service;
• Impersonate or post on behalf of any person or entity, or misrepresent your affiliation with a person or entity;
• Collect any personal information about other users, or intimidate, threaten, stalk or harass other users of the Service; and
• Circumvent or attempt to circumvent any filtering, security measures, rate limits or other features designed to protect the Service, users of the Service or third parties.

9punto5 materials

We put a lot of effort into creating the Service, including the logo and all designs, text, graphics, images, information and other content (excluding user content). This property is owned by us or our licensors and is protected by international and U.S. copyright laws. You are granted a limited right to use it within the Service.

However, unless we expressly state otherwise, that right does not include: (i) publicly performing or displaying the Service; (ii) modifying or making derivative uses of the Service or any part of it; (iii) using any data mining or data extraction methods, robots or similar data gathering or extraction methods; (iv) downloading (other than page caching) any part of the Service or any information contained in it; (v) reverse engineering or accessing the Service in order to build a competing product or service; or (vi) using the Service for purposes other than those intended. Failure to comply with these restrictions may result in termination of access to the Service.

Hyperlinks and third-party content

You may create a hyperlink to the Service. You may not use, frame or use framing techniques to include any of our trademarks, logos or other proprietary information without our express written consent.

9punto5 makes no claim or representation regarding third-party websites that can be accessed through a hyperlink from the Service or websites that link to the Service, and accepts no responsibility for them. Once you leave the Service, these Terms and our policies no longer apply.

User-generated content is not systematically reviewed, verified or authenticated, and may include inaccuracies or false information. We make no representations, warranties or guarantees regarding the quality, suitability, truthfulness, accuracy or completeness of any content included in the Service. Use of or reliance on any content of the Service is solely the responsibility of whoever uses it.

Unavoidable legal stuff

Anyone who uses the Service agrees to defend, indemnify and hold 9punto5 harmless from any and all costs, damages, liabilities and expenses (including attorneys’ fees, costs, penalties, interest and disbursements) that we incur in connection with, arising from or for the purpose of avoiding any third-party claim or demand related to their use of the Service or the use of the Service by anyone using the corresponding account, including any claim that such use violates any applicable law or regulation or the rights of any third party, and/or the breach of these Terms.

Copyright

We take intellectual property rights seriously. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, access to the service for users who are deemed repeat infringers.

Jurisdiction

Any dispute with the Service or related to its use is subject to the exclusive jurisdiction of the courts of Chile. Likewise, anyone who uses the Service consents to the exercise of personal jurisdiction by those courts in connection with any such dispute, including any claim involving the Service. Class actions, class arbitrations and other representative actions or proceedings brought against 9punto5 in connection with the Service will not be allowed.

Termination

Breach of any of these Terms may result in the suspension or disabling of access to or use of the Service.

Entire agreement

These Terms constitute the entire agreement between whoever uses the Service and 9punto5 regarding that use, superseding any prior agreement related to the Service.

Feedback

Any opinion, comment or suggestion about the Service, these Terms or 9punto5 in general will be considered irrevocably assigned to 9punto5, with all corresponding rights, title and interest.
